Vehicle owners will have to pay 18 percent of the goods and service tax (GST) for obtaining pollution certificates for their vehicles. The Advance Decision Authority (AAR) has given this arrangement.

The Goa Bench of AAR has given this arrangement on the appeal of Venkatesh Automobiles. Venkatesan Automobiles wanted to know whether GST was exempt from the pollution control certificate (PUAC) issued by the state government.

AAR said that the issuance of pollution control certificates by the applicant does not come under the service accounting code (ASC) 9991 (notified list of taxable services). The AAR has given this service an arrangement to provide 18 percent GST on the service as a residual entry service.

PUC is required for each vehicle running on roads. It is a matter of certainty that emissions in vehicles are in line with pollution rules and it is not harmful for the environment.

AAR said that the government has authorized the applicant to issue certificate of PUC (Pollution Control) on payment. This is the service provided by the applicant to consumers. After payment of service fee, pollution test is being provided. In such a situation, GST will look at the fixed rates.
