  1. Delhi government approves 66% hike in salaries of MLAs
  • The cabinet chaired by Chief Minister Arvind Kejriwal has approved a proposal to increase the salaries of MLAs by 66% . This hike has been done to increase the existing monthly salary and allowances of MLAs from Rs 54,000 to Rs 90,000 after a decade. The Kejriwal-led government had requested the Home Ministry to increase the salaries and allowances of Delhi MLAs at par with other states. MLAs in Delhi were earlier paid Rs 54,000 per month which included Rs 12,000 as salary and the rest as allowance. The salaries and allowances of Delhi MLAs were not revised since 2011.

  1. Parliament passed the Insolvency and Bankruptcy Code (Amendment) Bill, 2021
  • Rajya Sabha passed the Insolvency and Bankruptcy Code (Amendment) Bill, 2021 on August 3, 2021. The bill was passed by the Lok Sabha on July 28, 2021 and was introduced in the lower house on July 26, during the monsoon session. The Amendment Bill was introduced by Union Corporate Affairs Minister Nirmala Sitharaman which will amend the Insolvency and Bankruptcy Code, 2016 . Recent Amendment Bill Micro, Small and Medium Enterprises (MSMEs)will provide for an alternative insolvency resolution process. This resolution will be called the “Pre-packaged Insolvency Resolution Process (PIRP)”. It will initiate a time bound process to resolve insolvency issues of corporate debtors within 330 days. This process of resolution is called the Corporate Insolvency Resolution Process (CIRP). Under CIRP, the debtor or his creditors will be able to apply for initiation of CIRP in case of default of Rs. 1 Lac. A committee of creditors will also be constituted under CIRP to decide on insolvency resolution. The committee of creditors may consider a resolution plan for repayment of the debt by acquisition, merger or restructuring of the company. If the committee does not approve the resolution plan within the specified time, the company will be liquidated.

  1. Governor can pardon prisoners: Supreme Court
  • On August 3, 2021, the Supreme Court of India said that state governors can pardon prisoners, including those in death row cases . The governor can pardon prisoners even before they complete their sentence of at least 14 years in prison. The Bench also held that the Governor’s power to pardon overrides the provision made under section 433A of the Code of Criminal Procedure .Section 433A states that the sentence of a prisoner can be waived off only after 14 years of imprisonment. The bench said that under Article 433A of the Code, Article 72 or 161 of the Constitution, the President or the Governor cannot and does not affect the constitutional power to grant pardon. However, the Governor will have to act on the aid and advice of the State Government. The Court said that the sovereign power of the Governor to pardon a prisoner under Article 161 is actually exercised by the State Government and not by the Governor voluntarily. Article 161 of the Constitution of India empowers the Governor of a State to grant pardon, relief or punishment, or suspend, or reduce the sentence, any person convicted of any offense against the laws. The scope of the pardoning power of the President under Article 72 is wider than that of the Governor under Article 161 in two ways:
  1. Court Martial: The power of the President to grant pardon extends to cases where the sentence or punishment is awarded by a Court Martial. But no such power is available to the Governor.
  2. Death Penalty: Until now, only the President had the power to pardon in all cases, including the cases of capital punishment. Such power was not available to the Governor. However, recently the Supreme Court has reversed this provision of the Governor.
  3. IIT Roorkee launches Earthquake Early Warning Mobile App
  • Indian Institute of Technology Roorkee has launched Earthquake Early Warning (EEW) mobile app for Uttarakhand . Earthquake Early Warning Mobile App will alert people about the onset of the disaster. It can detect the onset of earthquakes and issue warnings before significant earthquakes occur in the state. This mobile app project was sponsored by the Uttarakhand State Disaster Management Authority (USDMA). In collaboration with the Union Ministry of Earth Sciences, this initiative was earlier launched as a pilot project for the Garhwal region of Uttarakhand. Later the Uttarakhand government extended it. Under this project, sensors have been installed in the highlands of Garhwal and Kumaon regions of Uttarakhand.
